These Terms of Service ("Terms") govern your access to and use of the ViableDx website, symptom triage tool, and related services (collectively, the "Services"), operated by ViableDx ("we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Not Medical Advice — Please Read Carefully

The Services, including the symptom triage tool, are research and informational tools only. They do not provide medical advice, diagnosis, or treatment, and are not a substitute for the judgment of a qualified healthcare professional. Using the Services does not create a doctor-patient relationship between you and ViableDx or any ViableDx personnel.

The triage tool does not name or diagnose medical conditions. It surfaces observable signs from the answers you provide and suggests a general urgency category to help you decide what to discuss with a healthcare provider — it does not tell you what is wrong or what treatment you need.

If you believe you are experiencing a medical emergency, call 911 (or your local emergency number) or go to the nearest emergency room immediately. Do not rely on the Services in an emergency.

2. Eligibility

The Services are intended for adults age 18 and older. By using the Services, you represent that you are at least 18 years old and, if you are using the triage tool for yourself, that you are the person whose symptoms are being described.

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Submit information about, or on behalf of, another person without their knowledge
• Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Services or the systems behind them
• Use automated means (scrapers, bots) to access the Services outside of normal use
• Misrepresent your identity or impersonate any person or entity

4. Facility Referrals and Booking

The Services may show you nearby imaging or care facilities, including estimated wait times or availability. This information may be sourced from third-party facility websites and is provided for convenience only — we do not guarantee its accuracy or that a facility is currently open, available, or able to see you.

Any booking, scheduling, and billing for imaging or care is a transaction between you and the facility you choose, not with ViableDx. ViableDx does not process payments, verify insurance, or guarantee pricing on a facility's behalf. Confirm cost, self-pay pricing, and availability directly with the facility before attending an appointment.

5. Privacy

Our Privacy Policy describes how we collect, use, and protect information in connection with the Services, including how symptom triage answers are handled anonymously and separately from any contact information you provide. The Privacy Policy is incorporated into these Terms by reference.

6. Intellectual Property

The Services, including their design, text, graphics, triage logic, and underlying software, are owned by ViableDx or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from the Services except as this license allows.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY TRIAGE RESULT, FACILITY INFORMATION, OR RECOMMENDATION IS ACCURATE, COMPLETE, OR CURRENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VIABLEDX AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF HEALTH, LIFE, DATA, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, TO USE THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold ViableDx harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Services.

10. Third-Party Links and Services

The Services may link to or reference third-party websites, facilities, or services that we do not control. We are not responsible for the content, accuracy, or practices of any third-party site or service.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or that your use poses a risk to us or others.

12. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles.

13. Changes to These Terms

We may update these Terms periodically. Any changes will be posted on this page with a revised effective date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
